  • 8) Deposit Requirements - To obtain a bidding number, you will be required to register a credit card with Obenauf Auction Service, Inc. $1.00 will be charged to your credit card. We use this as proof of buyer’s information. At no time will any other charges be made to your credit card.
  • 9) Bidding Plan - Bids will be accepted through our OnLine Auction Service. If you are unable to bid online, written bids will be accepted as proxy bids and we will enter your bids for you. If you need assistance in making a bid, please call our office 847-587-2095.
  • 10) Ending of the Auction - Following the auction, if you are the high bidder you will be notified, all under bidders will also be notified. Closing will be within 30 days from the end of the auction if you are the high bidder.

Auction Terms and Conditions

  • 1) A 3% “buyer’s fee” will be added to the high bid price to determine the TOTAL CONTRACT PRICE (High bid price + buyer’s fee = total contract price).
  • 2) A deposit of 5% of the total contract price will be required at the conclusion of the auction payable within 24 hours to the seller’s attorney, to be held in Escrow.
  • 3) A service fee of $1,500 payable to Obenauf Auction Service, Inc. is due at the conclusion of the auction for the local services provided, pre-auction through the closing. This fee is non-refundable. At closing, this fee will be credited towards the 3% Buyer’s Fee.
  • 4) The sale is not contingent upon financing, although financing is allowed.
  • 5) The subject property is sold “as-is” “where is” with no guarantee(s) expressed or implied.
  • 6) Closing to be within 30 days of the OnLine Auction conclusion.
  • 7) Possession to be at closing.
  • 8) Property taxes are to be pro-rated to the date of closing.
  • 9) Clear Title Insurance will be provided at the Seller’s expense.
  • 10) Title to be conveyed by a general Warranty Deed.
  • 11) Final Bid Subject to Seller’s Approval.
